Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Echoia website, applications and services (collectively, the “Service”). The Service is operated by Ilies Ziyad EL AYYADI, sole trader (entrepreneur individuel) trading as STUDIO DA, registered in France under SIREN 104 686 118, whose registered address is 60 rue François Ier, 75008 Paris, France (“we”, “our”, “us”). By creating an account or otherwise using the Service, you agree to be bound by these Terms.
1. Eligibility and accounts
You must be at least 16 years old to use the Service. You are responsible for the security of your account and password, and for all activity occurring under your account. You agree to provide accurate, complete and up-to-date registration information and to notify us promptly of any unauthorized use of your account.
2. Subscription, billing and trials
Paid plans are billed in advance on a recurring basis (monthly or annually). You authorize us, through our payment processor (Stripe), to charge the payment method you provide for the applicable subscription fees. We do not currently offer free trials.
Taxes. All prices are displayed excluding VAT and any other applicable tax. VAT is not currently applicable under Article 293 B of the French General Tax Code, so the amount charged today equals the price displayed. Where VAT or another indirect tax becomes applicable to your subscription, whether because our status changes or because of where you are established, it will be added to the displayed price from the next billing cycle following notice to you. That addition is not a price increase and does not require a new agreement. Business customers established in another EU member state who provide a valid VAT identification number are invoiced under the reverse-charge mechanism.
Each plan includes usage allowances (for example connected accounts, scheduled posts, AI messages, or platform-specific syncing volumes) described on the pricing page. When an allowance is reached, the related feature pauses until the next billing cycle or until you upgrade: we do not bill overages without your explicit action. We may adjust allowances prospectively with notice; we will not reduce what you have already paid for mid-cycle.
You can cancel a subscription at any time from your account settings. Cancellation takes effect at the end of the then-current billing cycle. We do not refund partial months unless required by applicable law.
3. Acceptable use
You agree not to use the Service to:
- violate any applicable law, regulation or third-party rights;
- send spam, harass others, or impersonate any person;
- circumvent the rate limits or quotas of any connected third-party platform;
- scrape, reverse-engineer or attempt to gain unauthorized access to the Service;
- use the Service to publish unlawful, infringing or harmful content.
4. Connected social platforms
The Service connects to third-party platforms — such as Instagram, Facebook, YouTube, TikTok, LinkedIn, X (Twitter), Threads, Bluesky, Pinterest and Google Business Profile — via each platform's authorization flow. By connecting an account, you authorize us to access only the data and actions covered by the permissions you approve, including publishing content and replies on your behalf when you request it. You represent that you have the right to connect and operate each account you connect. Your use of those platforms remains subject to their respective terms of service, and content you publish through Echoia must comply with the rules of the destination platform. We are not responsible for changes, downtimes, restrictions or fees imposed by those platforms.
5. AI features
The Service uses third-party AI providers to draft replies, classify content and extract insights. AI-generated outputs are suggestions only — you remain solely responsible for reviewing, editing and approving any content before it is published or sent. We make no warranty as to the accuracy, completeness or appropriateness of AI-generated content.
6. Content and data
You retain ownership of all content you upload, post or otherwise submit through the Service (“Your Content”). You grant us a worldwide, non-exclusive license to host, store, process and display Your Content solely for the purpose of operating and improving the Service. You are responsible for obtaining any rights or consents needed for the content you process through Echoia.
7. Intellectual property
The Service, including its software, design, branding and trademarks, is and remains the exclusive property of Ilies Ziyad EL AYYADI (STUDIO DA). We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell or sublicense any part of the Service.
8. Termination
We may suspend or terminate your access to the Service if you breach these Terms, abuse the Service, or expose us or other users to legal or operational risk. You may delete your account at any time. Upon termination, your right to use the Service ends immediately, and we may delete your data after a reasonable retention period as described in our Privacy Policy.
9. Disclaimers
The Service is provided “as is” and “as available”, without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free or secure, nor that any data, classification or insight will be accurate. During early access or beta periods, features may change, be renamed or be withdrawn as the product evolves.
10. Limitation of liability
To the maximum extent permitted by law, Echoia and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with these Terms or your use of the Service. Our aggregate liability under these Terms will not exceed the amounts paid by you to Echoia in the twelve months preceding the event giving rise to the claim.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of France, without regard to conflict-of-laws provisions. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer-law protections apply.
